Land Use
Lubin Olson's Land Use Practice Group encompasses all aspects of land use planning, environmental review, development entitlements, and land use and environmental litigation for a broad range of residential, retail, commercial, mixed-use, industrial and infrastructure projects.
We specialize in negotiating, documenting, bullet-proofing, and defending local, state and federal entitlements, with an emphasis in providing efficient, focused representation in the preparation of environmental review documents under the California Environmental Quality Act (“CEQA”) and the development of a defensible administrative record in anticipation of litigation. While our first priority is to avoid litigation where at all possible, our attorneys have a proven track record of successfully litigating cases under CEQA, the State Planning and Zoning Laws and related land use and environmental statutes at both the trial court and appellate levels. We also have extensive experience in the application of local planning and zoning laws, the Subdivision Map Act, the Cortese-Knox-Hertzberg Act, as well as related local, state and federal land use and environmental laws.
We also offer services pertaining to a wide range of natural resource and environmental issues that frequently arise in transactions involving real estate, timber, minerals, oil and gas, solar power, and water. We advise clients on matters relating to natural resource joint ventures, contracts, acquisition and disposition, solar, hydroelectric, cogeneration and other energy development projects, federal and state permitting, and environmental review and impact mitigation.
