Lubin Olson's Dennis Miller Wins Big at Bankruptcy Adversary Trial

Lubin Olson bankruptcy partner Dennis Miller prevailed at the trial of an adversary proceeding in In re Mac-Go Corporation, a Northern District of California Chapter 7 bankruptcy.  In that proceeding, the Chapter 7 trustee asserted avoidance claims against First National Bank of Northern California (FNB) and sought the return of more than $850,000 paid to FNB by Mac-Go Corporation.  The court concurred with nearly all of FNB’s arguments and entered a judgment after trial in which it awarded the trustee a mere $25,000 of its original claim.
